WHEREAS, Republic Act (RA) No. 7638, otherwise known as the "Department of Energy (DOE) Act of 1992" declares it the policy of the State to ensure a continuous, adequate, and economic supply of energy through the integrated and intensive exploration, production, management and development of the country's indigenous energy resources;

WHEREAS, Sections 30 and 37(f) of the Electric Power Industry Reform Act (EPIRA) provide that the DOE, jointly with the electric power industry participants, shall establish the Wholesale Electricity Spot Market (WESM) and formulate the detailed rules governing the operations thereof; 

WHEREAS, on 26 July 2018, the Department of Energy (DOE) issued Department Circular (DC) No. DC2018-08-0021, titled "Providing for the Amendments to Rule 29 Part (A) of the Implementing Rules and Regulations of Republic Act No. 9136, "which took effect on 23 August 2018, and establishes the rules and guidelines for the administration of financial benefits under the Energy Regulations No. 1-94 (ER 1-94) Program, in order to promote efficiency in the government processes and ensure that the financial benefits are properly allocated and availed of;
