WHEREAS, Republic Act (R.A.) no. 7638 " An Act Creating the "Department of Energy (DOE)", task the DOE to formulate rules and regulations as may be necessary to guide the operations of both government and private entities involved in energy resource supply and distribution; 

WHEREAS, pursuant to Republic Act Nos. 7638 (Department of Energy Act of 1992) and 8479 (Downstream Oil Industry Deregulation Act of 1998), Batas Pambansa BIg. 33 as amended by Presidential Decree 1865 (Defining and penalizing certain prohibited acts involving petroleum/petroleum products), and under pertinent rules and regulations, the DOE has the power to monitor, supervise and regulate the petroleum industry and impose corresponding administrative penalties for violations thereof;

Pursuant to Section 15 of R. A. No. 9367, otherwise known as Biofuels Act of 2006, the Department of Energy, in consultation with the National Biofuels Board, appropriate government agencies, and other stakeholders, hereby issues, adopts and promulgates the following implementing rules and regulations.

WHEREAS, PNS/DOE QS 006:2005 was promulgated on April 18, 2006 to supersede Pns 21:1997 as the latest revision/update of quality standard specification for Bunker Fuel Oils (BFO);
