Clarification on the Transitory Provisions in the DTI MC 22-09, "Supplemental Guidelines for the Implementation of DAO 22-01, series of 2022"

The Department of Trade and Industry (DTI) has issued Memorandum Circular 22-09 entitled, "Supplemental Guidelines for the Implementation of DAO 22-01, Series of 2022", which was published in The Philippine Star and Daily Tribune on 08 June 2022 and became effective on 09 June 2022. The said Circular defined the scope of products for safety and performance, specifically for air conditioners, refrigerators and lighting products and included transitory provisions to adjust the requirements introduced by DTI Department Administrative Order (DAO) 22-01.

Under the Transitory Provisions in Rule 5.1 of DTI MC 22-09, performance requirements or submission of energy labels for PS/ICC applications shall be required by the DTI-BPS starting 05 September 2023. This should not be confused with the DOE's mandatory compliance to energy performance and labeling requirements which is already in effect. Under DOE Department Circular DC2020-06-0015 and its Implementing Guidelines, all manufacturers, importers and distributors of energy consuming products shall comply with energy performance and labeling requirements effective June 18, 2021. DOE will also conduct Enforcement, Monitoring and Verification activities starting November 2022 for lighting products and January 2023 for other covered ECPs.
